May. 31st, 2012 09:05 pmA hot evening in July of 2011- disturbed by trauma, then tragedy, as a local physician, driving home from a country club martini event in his 5-series Beemer, felt something in between his starts, stops and texts.
"Something" proved to be a local high school student, heading home from her job at a local pizzeria on her longboard, who got in the way of the doctor's rather polluted path. She didn't survive the crash. Doc did not stop. He headed home, parked the Beemer in the garage, sent his wife out to see what had happened, and lawyered up....
And, last night, was acquitted by a jury of his peers of all but a trivial misdemeanor DWI count.
One of theheadcornerstones of his defense was the complete and utter cushioning of his undpercentervagen, which so insulated him from outside noise, he couldn't have reasonably been expected to hear the crash and death of a teenager who he splatted half a football field away from the point of impact.

Local reaction to the verdict is widespread, and angry- at these 12 veniremen and women, who bought into the very expensive presentation of "reasonable doubt" put on by Doc's three high-powered defense lawyers; who wouldn't even convict him of per se felony DWI for driving with more than .08 percent BAC when a court-ordered blood test, hours after the drinking and killing were over, still had him at .10. (They believed the defense expert's qualms about the test.) Thank gods the DA is determined to retry him on that count; it'll take a felony conviction to automatically yank his medical license, though not his golfing privileges that he continued using at various clubs while he was under arrest.
In other local news from earlier today, a 24-year old kid, who was also driving drunk on a local highway and fled the scene of an accident killing a bicyclist, admitted his guilt in a court of law and will face mandatory jail time for his crime. What was HE thinking? Clearly there were missed opportunities for intentional infliction of reasonable doubt here. The local bar association will likely condemn his misguided attempt to do the right thing. After all, lawyers have to earn a living.
And some of them, and their clients, should die in fires.
