captainsblog: (Snape)
This one wasn't as long or complicated as the last one, but it still ate my sleep, my brain and my patience, more or less in that order.

Insomnia is becoming an almost regular visitor to my overnights. Granted, this time I brought it on myself- serenading wife, child and BF with the Rifftrax of Last Airbender right before bedtime. Fifty-odd minutes in, knowing I needed to be Up and Out early, I packed it in, and got a good four hours or so of snooze before the wakies arrived and consumed most of the ensuing three-plus hours. Then it was feeding time and, an hour or so later, a final not-quite-hour appended the night's total before the alarm went off.

Two court appearances today, 70 miles and two-plus hours apart. I arrived in Rochester on time for the first, only to find that my opponent, the one local to the court, had missed my letter rescheduling it to 11:30. So we did it with him on the phone- just as we could've done it with both of us, or just me, on the phone. At least I got brownie points for showing up on time and having a decent defense for once.

The delay in starting meant I had to scoot damn fast to get to the Buffalo one a minute or two late, but no harm- client checked in and the hearing officer was still giving his Small Claims Court For Dummies speech when I slipped in. Before us were two contested cases, featuring the two primary residents of the Small Claims part: the anal and the stupid.

The former, aka The Case of the Mysterious Scraping: Dude was suing Delta Sonic, the WNY car wash chain which I had a bit of a tilt with myself back in May. The case was in Buffalo City Court, but the incident occurred in a Rochester suburb, where his car got allegedly scraped on the roof and sides during the trip down the Superkiss Tunnel of Love (which I swear I am not making up). He was basically looking for a complete car dollup from Ziebart on account of their "negligence," but could not offer any proof that the scratches on his car were caused by the car wash.  He's gonna lose,  but the sad thing is, even though he sued them, Delta Sonic gave him $200 worth of car wash coupons- way more than the 50 or so of coupons and dry cleaning reimbursement I got after being decent with them earlier in the year. That'll teach me.

The latter, aka The Case of the Plainly Mistaken Identity. This guy was claiming that his landlord improperly disposed of his property after his eviction earlier in the year. A lawyer showed up for the lady he sued, asking for an adjournment so he could move to dismiss for naming of an improper party. He brought the papers from said eviction, which had been brought by a totally different entity, not the poor Schnooki in charge of collecting the rent from him who he'd decided to sue. The judge told him repeatedly that he could come back in November, but that his case would be dismissed then if he didn't name the right party by then. I put the chances of that happening somewhere on par with the Buffalo Bills winning the Super Bowl. Not this coming year's; last year's.

After all that, we got called, on a simple unpaid rent dispute. Since my client had a lawyer, the other side demanded an adjournment so SHE could get one (she's had notice of the hearing since April). These are granted for any or no reason the first time round, so we're coming back in, you betcha, November. When the Bills will likely be as close to winning a Super Bowl as they've ever been:P

By early evening, the lack of sleep and two workouts in 24 hours had caught up with me, and I am therefore passing on the remaining hour-and-change of Riffairbender for the time being. Hasta la pastas.
